If mediation is unsuccessful, any remaining Dispute shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Bergen County, New Jersey. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the above, either party may bring an action in court for injunctive relief or to protect intellectual property rights. Nothing in this section shall prevent you from filing a complaint with any applicable regulatory agency, including the New Jersey Division of Consumer Affairs.
We reserve the right to revise and update these Terms of Service at any time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Site thereafter.
